Dumpster Permit Guide: Middlesex County 2026

Here is the honest answer: probably not, if the dumpster goes on your driveway.
But if you need it on the street — in front of your house, in a cul-de-sac, or on a public right-of-way — then yes, most towns in Middlesex County require a permit. The rules, fees, and timelines vary by town.

The General Rule in Massachusetts
Private property (driveway, yard, parking lot you own): No permit required in any of our service towns. You can place a dumpster on your own property without asking anyone.
Public street or town right-of-way: You need a Street Occupancy Permit (sometimes called a Road Occupancy Permit or Right-of-Way Permit) from your town's Department of Public Works (DPW) or Engineering Division.
Commercial property: If you own or lease the lot, no permit needed for on-site placement. If you need to block a public sidewalk or street for loading, you likely need a permit.

- Processing time: 1-2 business days
- Notes: Billerica is our home base. We know the DPW process here better than anyone. Most customers place the dumpster on their driveway and skip the permit entirely.
Chelmsford
- Private property: No permit needed
- Street placement: Permit from Chelmsford DPW/Highway Department
- Processing time: 1-2 business days
- Notes: Chelmsford has specific rules about placement distance from intersections. Must not block sidewalks or impede traffic flow. Some neighborhoods with narrow streets may have additional restrictions.
Lowell
- Private property: No permit needed
- Street placement: Street Occupancy Permit from Lowell DPW
- Processing time: 2-3 business days
- Notes: Downtown Lowell has tight one-way streets where dumpster placement is challenging. Some streets near UMass Lowell campus have additional parking restrictions during the school year. Multi-family homes in older neighborhoods may need creative placement due to shared driveways.
Tewksbury
- Private property: No permit needed
- Street placement: Highway Department permit
- Processing time: 1-2 business days
- Notes: Most Tewksbury homes have adequate driveway space for dumpster placement without needing a street permit.
Lexington
- Private property: No permit needed
- Street placement: Right-of-Way Permit from Lexington Engineering Division
- Processing time: 2-3 business days
- Historic District warning: If your property is in or near one of Lexington's Historic Districts (Battle Green, Munroe Tavern area, Lexington Center), you may face additional placement restrictions and time limits. The town takes the visual impact seriously. We recommend private property placement or our live-load service to avoid complications.
- Notes: Many older Lexington homes have narrow or shared driveways. We use smaller, more maneuverable trucks and can often find a spot on your property that avoids the street entirely.
Burlington
- Private property: No permit needed
- Street placement: DPW permit required
- Processing time: 1-2 business days
- Notes: Commercial areas along Route 3A and the Burlington Mall area may have additional requirements for contractors.
Wilmington
- Private property: No permit needed
- Street placement: Highway Department permit
- Processing time: 1-2 business days
Bedford
- Private property: No permit needed
- Street placement: DPW permit required
- Processing time: 1-2 business days
- Notes: Bedford's historic town center area may have additional guidelines.
Carlisle
- Private property: No permit needed
- Street placement: Road Commissioner or Highway Department permit
- Processing time: 2-3 business days
- Notes: Carlisle has many narrow rural roads. Placement should not impede traffic or emergency vehicle access.
Dracut
- Private property: No permit needed
- Street placement: Highway Department permit
- Processing time: 1-2 business days
Westford
- Private property: No permit needed
- Street placement: DPW/Highway Department permit
- Processing time: 1-2 business days
Andover
- Private property: No permit needed
- Street placement: DPW permit required
- Processing time: 2-3 business days
- Notes: Andover has strict enforcement. Make sure your permit is in hand before placement.
Woburn
- Private property: No permit needed
- Street placement: DPW/Engineering permit required
- Processing time: 1-2 business days
HOA and Historic District Restrictions
Even if you do not need a town permit, your Homeowners Association (HOA) may have rules about dumpster placement:
- Duration limits: Many HOAs limit how long a dumpster can stay (typically 3-7 days)
- Placement requirements: Must be on your driveway, not on the lawn or common areas
- Notification: Some require you to notify the HOA board before delivery
- Visual screening: Occasionally required in high-end communities
Historic Districts (common in Lexington, Concord, and parts of other towns) may have additional rules:
- Shorter placement duration
- Restrictions on where the dumpster can be visible from the street
- Approval from the Historic District Commission in some cases
How to Avoid Needing a Permit
Most of our customers never need a permit. Here is how:
- Use your driveway. The most common and easiest option. We place plywood boards under the dumpster to protect your surface.
- Use your yard. If your driveway is too narrow or full, we can place the dumpster on a flat section of your yard. We use boards to protect the grass.
- Use a live-load service. We bring the dumpster, you load it while we wait, and we take it away immediately. No permit, no neighbor complaints, no multi-day eyesore.
- Use our 3-day rental. Even if you do need a street permit, the short rental period means less bureaucratic hassle and less time for neighbors to notice.
What Happens If You Skip the Permit?
We do not recommend it. Here is what can happen:
- Fines: Most towns charge $50-200 for an unpermitted dumpster on a public way
- Towing: The town can have the dumpster removed at your expense
- Liability: If an accident occurs involving an unpermitted dumpster on a public road, you may be personally liable
National dumpster brokers often drop the container without mentioning permit requirements. They are gone before the town notices. You are the one who gets the fine.
